Short Term Rental Agreement · Casita Dunsmuir · Version 2026-08-04

This agreement is between the property owners (the Hosts) and the Guest for the stay from your check in date (check in after 4:00 PM) to your check out date (check out by 11:00 AM) at the property in West Adams, Los Angeles, CA. The exact address is provided after the booking is confirmed. City of Los Angeles Home Sharing Registration HSR24-003532.

1. Transient stay, not a tenancy. This is a license for transient occupancy of under 30 days, not a lease. The Guest is a licensee, not a tenant, gains no tenancy rights, and agrees to leave at the end of the stay. Los Angeles transient occupancy tax is collected on the booking.

2. Occupancy and identity. No more than 6 overnight guests (infants under 2 not counted). The Guest signing must be at least 21, must be personally staying at the property for the entire stay, and must be the person whose payment method is used. Bookings on behalf of someone else (third party bookings) are not permitted. The Hosts may request a government photo ID matching the booking name before releasing entry codes, and may cancel with a full refund if identity cannot be reasonably verified.

3. House rules. No smoking or vaping indoors. No pets. No parties, events, or gatherings beyond the registered guests. Quiet hours begin at 10pm. No commercial photography or filming without written permission. The Guest may not assign this agreement or sublet any part of the property. The Guest is responsible for the conduct of everyone in their party and any visitors.

4. Payment, cancellation, refunds. The total shown at checkout includes the nightly rate, cleaning fee, and occupancy tax. Cancellation by the Guest: full refund up to 14 days before check in, 50 percent refund up to 7 days before check in, nonrefundable after that. Refund windows are measured to 4:00 PM Pacific on the arrival date. Leaving early does not entitle the Guest to a refund of unused nights. Bank transfer (ACH) payments are refunded after the original payment has fully settled, which can add a few business days. If a bank transfer fails or is returned, the booking is released and any hold on the dates ends.

5. Damage and excess cleaning. The Guest accepts responsibility for loss or damage to the property and contents beyond normal wear caused by their party, and for cleaning beyond a normal turnover. After written notice with photos and receipts, the Guest authorizes the Hosts to charge the payment method on file for documented, itemized costs up to $2,000, or to invoice the Guest, payable within 14 days. Amounts above that may be pursued through other lawful means.

6. Fire pit, grill, and grounds. The gas fire pit and grill may only be operated by adults and must be turned off after use. Children must be supervised at all times, including in the backyard. Fruit from the trees is offered as is. The Guest party uses the property, indoors and out, at their own risk.

7. Liability and indemnity. To the maximum extent permitted by California law, the Hosts are not liable for injury, loss, or damage to the Guest party or their belongings except where caused by the Hosts' gross negligence or willful misconduct, and total liability is limited to the amount paid for the stay. The Guest agrees to indemnify the Hosts against third party claims arising from the Guest party's use of the property or breach of this agreement.

8. Access and termination. The Hosts may enter in an emergency or, with reasonable notice, for urgent repairs. The Hosts may terminate the stay without refund if the Guest materially breaches this agreement, including exceeding occupancy, holding a party, or smoking indoors. Checking out after 11:00 AM without approval may be charged at up to one additional night's rate.

9. Chargebacks. The Guest agrees not to initiate a payment dispute in place of the refund process above, and acknowledges that this signed agreement, the house rules, and booking communications may be submitted as evidence in any payment dispute.

10. Cameras. Four security cameras monitor the exterior of the property. There are no cameras inside the home, and no audio monitoring indoors. Disabling, obstructing, or disconnecting a camera is a material breach of this agreement.

11. Force majeure. If the property becomes uninhabitable or the stay is prevented by events beyond either party's control, the Hosts will refund unspent nights, and that refund is the full remedy.

12. General. California law governs. Any dispute not resolved informally will be brought in small claims court where eligible, otherwise in the state courts of Los Angeles County. The prevailing party in any action is entitled to reasonable attorney fees and costs. This is the entire agreement between the parties for this stay and can only be amended in writing. A failure to enforce any clause is not a waiver of it. If any clause is unenforceable the rest stands.

13. Electronic signature. Typing your full name below and checking the box constitutes your electronic signature under the E-SIGN Act and California UETA. We record the signed name, date, time, IP address, and agreement version with your booking.
